Welcome to HabitatOS. These Terms of Use ("Terms") are a legal agreement between you and Paladin Labs LLC, an Indiana company ("Paladin Labs," "HabitatOS," "we," "us," or "our"). These Terms govern your access to and use of HabitatOS, including our mobile application, website, account features, subscriptions, support channels, and related services (collectively, the "Service").
By downloading, accessing, creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
HabitatOS is a reptile care organization and husbandry tracking service. The Service may allow you to track animals, care schedules, reminders, feeding, misting, shedding, weight, health checks, medication, breeding records, enclosures, zones, sensor readings, passport records, public sharing links, transfers, exports, and related information.
The Service is provided for informational, organizational, and recordkeeping purposes only. HabitatOS is not veterinary care, medical advice, legal advice, emergency monitoring, or a substitute for professional judgment.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian.
By using the Service, you represent that you have the legal authority to agree to these Terms and that your use of the Service will comply with all applicable laws and regulations.
You may need an account to use certain features. Account access may be created or managed through email/password login, anonymous device-based access, Sign in with Apple, Google Sign-In, recovery keys, or other supported methods.
You are responsible for maintaining the confidentiality and security of your account, password, recovery key, device, app-store account, and any third-party provider credentials you connect to HabitatOS.
You agree to provide accurate account information and to promptly update it if it changes. You are responsible for activity that occurs through your account unless caused by our failure to use reasonable security measures.
You must notify us promptly at support@habitatos.io if you believe your account has been accessed without authorization.
You retain ownership of the content and records you submit to HabitatOS, including reptile names, photos, notes, care logs, husbandry records, breeding records, enclosure data, sensor mappings, passport records, and other user-generated content ("User Content").
By submitting, uploading, syncing, importing, sharing, or otherwise providing User Content to the Service, you grant Paladin Labs a limited license to host, store, process, display, transmit, back up, convert, compress, analyze, export, and otherwise use that User Content as necessary to provide, maintain, secure, and improve the Service.
You are responsible for your User Content, including its accuracy, legality, and any permissions needed to upload, share, transfer, or publish it.
If you upload reptile photos or other media, you represent that you have the right to do so. HabitatOS may process photos by compressing, converting, storing, displaying, and associating them with your account or reptile records.
HabitatOS does not currently use AI photo analysis. If AI photo analysis is introduced in the future, we will update our applicable disclosures before using that feature.
HabitatOS may include reptile passport features, public share links, QR codes, PDF exports, transfer flows, recipient invitations, and ownership-history features.
You are responsible for reviewing any information before you share, export, publish, or transfer it. If you create a public passport link, anyone with access to the link or public slug may be able to view the information made available through that link until you revoke sharing or delete the related data.
We are not responsible for how recipients or third parties use, copy, save, forward, download, or rely on information you choose to share.
The Service may allow you to connect third-party sensor providers, such as MOCREO, Govee, Tuya/Smart Life, SensorPush, Inkbird, Herpstat, Shelly, SwitchBot, or other supported providers.
Sensor integrations are optional. If you connect a sensor provider, you authorize HabitatOS to use the credentials, tokens, API keys, or connection details you provide to access that provider on your behalf and retrieve device, environmental, and telemetry data.
You are responsible for ensuring that you are authorized to connect any third-party account, device, or sensor provider. Your use of third-party sensor providers is also subject to their own terms, privacy policies, account rules, API restrictions, fees, and service availability.
Sensor readings, alerts, dashboard summaries, and thresholds may be delayed, incomplete, inaccurate, unavailable, or affected by device failure, network issues, provider outages, sync delays, user configuration, battery status, calibration, enclosure placement, or other factors. HabitatOS is not an emergency monitoring system and should not be relied on as the only way to protect animal health or safety.
HabitatOS may provide species information, husbandry guidance, automated calculations, care summaries, reminders, alerts, passport scores, trend indicators, environmental ranges, and other automated features.
These features are informational tools only. They may be incomplete, inaccurate, outdated, delayed, or not appropriate for a particular animal, species, enclosure, location, or situation.
You are responsible for your care decisions. Always consult a qualified reptile veterinarian or other appropriate professional for animal health, safety, legal, or emergency concerns.
HabitatOS may offer free and paid subscription tiers. Paid features, limits, pricing, trial availability, renewal terms, and subscription names may vary by platform, country, promotion, or app-store listing.
Subscriptions may be purchased through Apple, Google, RevenueCat, or another app-store or payment platform. When you purchase through a third-party platform, billing, renewal, cancellation, refund eligibility, taxes, payment method handling, and subscription management are governed by that platform's terms and policies.
Subscriptions may renew automatically unless canceled before the renewal date according to the rules of the applicable platform. You can usually manage or cancel app-store subscriptions through your Apple App Store or Google Play account settings.
We do not directly process full payment card details. We may receive subscription status and entitlement information so we can determine access to paid features.
Except where required by law or the applicable app-store policy, payments are non-refundable and we do not provide credits for partial subscription periods, unused features, or account inactivity.
If you downloaded the app through Apple App Store, Google Play, or another platform, your use of the app may also be subject to that platform's terms, rules, and policies.
The app store or platform is not responsible for providing maintenance or support for the Service unless required by applicable platform terms. To the extent these Terms conflict with mandatory app-store terms, the applicable app-store terms will control only for that conflict.
You agree not to misuse the Service. You must not:
The Service, including its software, design, interfaces, branding, logos, workflows, species database, generated layouts, templates, documentation, and other materials, is owned by Paladin Labs or its licensors and is protected by intellectual property and other laws.
These Terms do not transfer ownership of the Service to you. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business reptile care recordkeeping, subject to these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service except as permitted by law or with our written permission.
If you send us feedback, suggestions, ideas, bug reports, or feature requests, you grant us permission to use them without restriction or compensation to you. We are not required to treat feedback as confidential.
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge our Privacy Policy.
You may stop using the Service at any time. You may delete your account through the app where available or by contacting support@habitatos.io.
We may suspend, restrict, or terminate your access to the Service if we reasonably believe you violated these Terms, created risk for us or others, used the Service unlawfully, abused support or infrastructure, attempted unauthorized access, or created security, legal, or operational risk.
After termination or account deletion, some provisions of these Terms will continue to apply, including provisions related to ownership, user responsibility, disclaimers, limitation of liability, dispute resolution, and any unpaid amounts.
We may modify, suspend, discontinue, limit, or remove parts of the Service at any time. We may also update features, pricing, subscriptions, integrations, supported providers, limits, species data, app requirements, and platform availability.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times. Some features may depend on third-party providers, app stores, hosting services, internet connectivity, devices, sensors, operating systems, or user configuration.
HabitatOS may include local storage, sync, export, import, and backup-related features, but we do not guarantee that any data will always be available, recoverable, complete, or error-free.
You are responsible for maintaining your own backups of important records, exports, photos, and animal care information. We are not responsible for loss of data except to the extent liability cannot be excluded under applicable law.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Paladin Labs disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.
We do not warrant that the Service, care guidance, species information, sensor readings, reminders, alerts, passport scores, exports, public links, or third-party integrations will be accurate, complete, timely, uninterrupted, secure, or suitable for any particular purpose.
No information provided through the Service should be treated as veterinary, medical, legal, emergency, or professional advice.
To the fullest extent permitted by law, Paladin Labs and its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, animal injury, business interruption, service interruption, or substitute services, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to HabitatOS for the Service in the three months before the event giving rise to the claim; or (b) $100.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limits may not apply to you.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Paladin Labs and its owners, officers, employees, contractors, affiliates, service providers, and licensors from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a claim, you agree to first contact us at support@habitatos.io and attempt to resolve the dispute informally. Include your name, account email if applicable, a description of the dispute, and the relief you are seeking.
If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Indiana, unless applicable law requires a different venue. You and Paladin Labs consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will update the effective date and provide notice as required by law. Your continued use of the Service after updated Terms are posted or become effective means you accept the updated Terms.
If you do not agree to updated Terms, you must stop using the Service.
These Terms, together with the Privacy Policy and any additional terms presented in the Service, make up the entire agreement between you and Paladin Labs regarding the Service.
If any part of these Terms is found unenforceable, the remaining parts will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
You may not assign or transfer these Terms without our consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or by operation of law.
