Data Deletion and Privacy Rights Policy

This Data Deletion and Privacy Rights Policy explains how users may request account deletion, data deletion, access, correction, export, and other privacy-related assistance for HabitatOS. This Policy is part of the HabitatOS Privacy Policy and Terms of Use.

1. Response Timeframes

We respond to verifiable privacy requests within the timeframes required by applicable law. For requests under U.S. state privacy laws, we generally respond within forty-five (45) days and may extend by an additional forty-five (45) days where reasonably necessary, with notice. For requests under the EU or UK GDPR, we respond within one (1) month and may extend by up to two (2) additional months for complex or numerous requests, with notice. If we cannot act on a request, we will explain why, to the extent permitted by law, and tell you how to appeal or complain.

2. Authorized Agents and Appeals

You may use an authorized agent to submit a request where applicable law allows, and we may require proof of the agent's authority and verification of your identity. If we deny a request, you may appeal by replying to our decision with the word "Appeal" in the subject line; we will respond to appeals within the time required by applicable law and, where required, provide information about how to contact the relevant regulator.

4. In-App Account Deletion

Where available, you may delete your account from the HabitatOS app through Settings or Data & Privacy features. Account deletion is intended to delete or disable your HabitatOS account and remove associated server-side account data, including synced reptile records, care logs, sessions, push tokens, reminders, subscription records stored by HabitatOS, and related server records.

Some local data may remain on your device after account deletion unless you clear app data, clear local storage, or uninstall the app.

6. Identity Verification

Before completing a privacy request, we may need to verify your identity. Verification may include confirming control of the email address associated with your account, requesting additional account details, or taking other reasonable steps.

If we cannot verify that you are authorized to make the request, we may deny or limit the request.

Where applicable law allows you to use an authorized agent, we may require proof that the agent is authorized to act for you. We may also require you to verify your identity directly with us.

9. Information That May Be Retained or Anonymized

Some information may be retained, anonymized, or not fully deleted where necessary or appropriate, including:

10. Public Passport Links and Shared Records

If you created a public passport link, QR code, transfer link, PDF export, or shared record, deleting your account may revoke or remove some shared records controlled by HabitatOS.

However, people who previously accessed, copied, downloaded, screenshotted, forwarded, printed, or otherwise saved shared information may retain copies outside HabitatOS. We cannot delete information from recipients' devices or third-party locations that we do not control.

11. Sensor Provider Accounts

Deleting your HabitatOS account does not delete your account with any third-party sensor provider, such as Govee, SensorPush, Tuya/Smart Life, MOCREO, Inkbird, Herpstat, Shelly, SwitchBot, or other connected providers. If you want to delete information held by a third-party provider, disconnect the integration where available and contact that provider directly.

12. Subscriptions and App-Store Billing

Deleting your HabitatOS account does not automatically cancel a subscription billed through Apple, Google, RevenueCat, or another app-store or payment platform.

You are responsible for canceling subscriptions through the platform that bills you. If you delete your HabitatOS account but do not cancel your app-store subscription, the platform may continue billing you according to its own rules.

13. Processing Time

We will respond to privacy requests within the timeframe required by applicable law. If we need more time, we may notify you as permitted by law.

Some deletion processes may take additional time to complete because of backups, security logs, app-store billing records, public sharing records, or third-party provider limitations.

14. Appeals

If we deny your privacy request, you may appeal by replying to our decision email with the word "Appeal" in the subject line and explaining why you believe the decision should be reconsidered.

We will review appeals according to applicable law.

15. No Sale or Cross-Context Behavioral Advertising

HabitatOS does not sell personal information and does not share personal information for cross-context behavioral advertising. If this changes, we will update our Privacy Policy and provide any required opt-out mechanisms before engaging in those practices.

16. Children's Requests

HabitatOS is not intended for children under 13. If you believe a child under 13 has provided personal information to HabitatOS, contact Support@habitatos.io so we can review and take appropriate action.

17. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will update the effective date and provide notice where required by applicable law.
